Choosing someone to act for you is a personal decision. These answers explain the different roles and can help you think about who you would trust with each one.

Are property and personal care covered by the same document?

Ontario distinguishes between powers of attorney for property and for personal care. Property concerns financial matters; personal care concerns decisions such as health care and living arrangements when you cannot make those decisions yourself.

Does the person I appoint need to be a lawyer?

No. In this context, attorney means the person you appoint to act for you. Choosing someone you trust, who understands the responsibilities and is willing to act, is important.

When can the person I appoint begin making decisions?

It depends on the document and the type of decision. A property power of attorney can take effect while you are capable, unless its terms restrict that authority. Personal-care authority applies when you are incapable of the relevant decision.

Does a power of attorney continue after death?

No. Powers of attorney end at death. Administration of the estate is a separate role, carried out by an estate trustee.
